Terms of Service

1. Acceptance of Terms
By registering for or using the MyGOPHub mobile or web application (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not register and do not use the Service. The Service is operated by the GOP Cherokee (the “County Committee”) together with the platform infrastructure operator (collectively, “we,” “us,” or “our”).
2. Eligibility
To create an account you must:
- Be at least sixteen (16) years of age (consistent with our Privacy Policy);
- Be a United States resident for full feature access (donations and ballot data are scoped to United States jurisdictions);
- Provide accurate registration information and keep it current.
The Service is a members-only platform. The County Committee may, in its discretion, reject or remove accounts that do not meet membership eligibility under the County Committee’s bylaws.
3. Account Responsibilities
You are responsible for:
- Keeping your account credentials confidential;
- All activity that occurs under your account;
- Notifying us promptly at support@mygophub.com of any unauthorized access to or use of your account.
You may not share, sell, transfer, or assign your account to any other person.
4. Acceptable Use
You agree that you will not:
- Use the Service for any unlawful purpose;
- Harass, threaten, defame, or impersonate any person;
- Upload content that infringes intellectual-property rights or violates the privacy of any person;
- Scrape, mirror, or use automated tools to extract content or data from the Service without our prior written permission;
- Attempt to bypass authentication, rate limits, role-based access controls, or any other security control;
- Use the impersonation features (if extended to you as an administrator) for any purpose other than legitimate support;
- Interfere with or disrupt the Service or the servers and networks that host it.
We may suspend or terminate accounts that violate this Section without prior notice.
5. Member-Generated Content
You may submit content to the Service, including poll responses, message text, candidate application content, comments, and other materials (“Member Content”). You retain ownership of your Member Content. By submitting Member Content you grant us a worldwide, non-exclusive, royalty-free license to host, display, store, reproduce, and distribute that content within the Service for the purpose for which you submitted it.
You represent that you have all rights necessary to grant this license and that your Member Content does not violate any third party’s rights or any applicable law.
6. Donations
Donations are processed by Stripe, Inc. Donations are not refundable once collected, except as required by law or expressly stated below.
- Donations to candidates flow to the candidate’s own Stripe Express account. Each candidate is responsible for their own FEC reporting, contribution-limit compliance, and disclosures. The Platform is not a registered political committee and does not act as the candidate’s campaign treasurer.
- Donations to county or state party committees flow to the respective committee’s Stripe Express account, subject to the same allocation of responsibility.
- Donations to charities (where the Platform hosts a charity campaign) flow to the platform Stripe account and are paid out to the listed 501(c)(3) charity per the charity-campaign agreement.
Political donations are not tax-deductible.
Charitable donations are tax-deductible only when the recipient is a registered 501(c)(3) and the donation is processed as a charity-campaign donation. The Platform does not issue tax receipts for political donations. You are responsible for complying with all federal and state contribution-limit rules that apply to you.
7. Subscriptions and Memberships
The Service offers paid subscriptions, including County Membership tiers (billed through the County Committee’s Stripe Express account) and the Platform Supporter tier (billed through the platform Stripe account).
- Subscriptions are billed in advance, on a monthly or annual cycle as you select at checkout.
- You may cancel a subscription at any time from inside the application via Profile > My Memberships.
- Cancellation stops the next renewal; subscription rights remain active through the end of the billing period for which you have already paid.
- Refunds for unused subscription time are at the Platform’s discretion and are not guaranteed except where required by law.
8. Ticketed Events
Some events offered through the Service require a paid ticket. Ticket purchases are processed by Stripe. Refund and cancellation policies for tickets are set by the event organizer. Where the Platform charges a service fee, that service fee is non-refundable. Disputes about a specific event should be directed first to the event organizer.
9. Sweepstakes
From time to time the Platform may host sweepstakes. Each sweepstakes is governed by its own official rules, which will be made available before entry. Sweepstakes are void where prohibited by law. No purchase is necessary to enter where required by law; the alternate-entry method, where applicable, will be set out in the sweepstakes rules.
10. Advertising Campaigns
Candidates and county committees may purchase display advertising on the Platform through Stripe Checkout. All ad creative is subject to administrator review and may be rejected or removed at the Platform’s discretion. The display of an advertisement does not constitute an endorsement of the advertiser by the Platform.
11. Political Content Disclaimer
The Service is operated by a Republican Party committee. Content displayed on the Service represents the views of the County Committee, its members, and the candidates and organizations who submit content. The platform infrastructure operator does not, by hosting the Service, endorse any specific candidate beyond the affiliation of the operating County Committee. Information on the Service is provided for informational and organizational purposes only and does not constitute legal, financial, or tax advice.
12. Intellectual Property
All Platform code, design, layout, original written content, and platform-owned trademarks are owned by the platform infrastructure operator. “MyGOPHub” and the related logos are trademarks of the platform infrastructure operator. GOP Cherokee branding, marks, and original written content authored by the County Committee are owned by the County Committee. You may not copy, modify, distribute, or create derivative works of any of the foregoing without our prior written consent, except as expressly permitted by these Terms or by applicable law.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the foregoing limitations apply only to the maximum extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless the Platform, the County Committee, and their respective officers, employees, agents, and affiliates from and against any claim, loss, damage, liability, or expense (including reasonable attorneys’ fees) arising out of (a) your use or misuse of the Service, (b) your Member Content, or (c) your breach of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles.
17. Dispute Resolution
You and the Platform agree to attempt in good faith to resolve any dispute informally before initiating any formal proceeding. If a dispute cannot be resolved informally within thirty (30) days, either party may pursue the dispute in the small-claims court located in Cherokee County, Georgia, or, where the amount in controversy exceeds the small-claims jurisdictional limit, in the state or federal courts located in Cherokee County, Georgia. Each party consents to the personal jurisdiction of those courts.
18. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will be revised when we do. For material changes that affect your rights, we will additionally notify you through an in-app notice or transactional email. Your continued use of the Service following the effective date of any update constitutes your acceptance of the updated Terms.
19. Termination
We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, harms other users, or exposes us to legal liability. You may close your account at any time from inside the application via Profile > Security > Delete Account.
